It looks like the ISP still throttles outbound speed by simply dropping outbound packets, doing no prioritizing for acks, so hitting the outbound throttle caused inbound speed to flail wildly and generally cause horrible inbound performance.
I just put in a QOS limit on our router to limit outbound speed to a couple of kbps under the limit, and everything leveled out and inbound speed is now stabilized and sitting at a constant level right at the speed limit.
